The Will of Thomas Perkins 1806

This is the last will and testament

of me Thomas Perkins of Iford in the county of Somerset fuller

First I give and bequeath unto my wife Sarah Perkins such part

and parts of my household goods and furniture plate linen china

and other implements of housekeeping as she shall choose not exceeding

in value the sum of thirty pounds to be determined by some

indifferent person to be chosen jointly by my said wife and executors

hereinafter named within three months next after my decease I

give devise and bequeath unto my brother William Perkins of

Trowbridge in the county of Wilts clothier and my friends Benjamin

Brown of Iford aforesaid maltster and Henry Batten Pooll of Road

in the said county of Somerset clothier all those my three tenements

or cottages gardens and premises at Road aforesaid in the

several occupations of Thomas Wardour Fanny Stevens and

William Osborne with all appurtenances thereto belonging to

hold the same hereditaments unto the said William Perkins Benjamin

Brown and Henry Batten Pooll their heirs and assigns to for

use of my daughter Elizabeth Perkins and her assigns for and during

the term of her natural life and from and immediately after her

decease then to the use of all and every the children of my said

daughter Elizabeth Perkins their heirs and assigns equally between

them if more than one as tenants in common and not as joint

tenants but if there shall be but one such child then to the

use of such only child his or her heirs and assigns and for want

or in default of such issue then to the use of all and every my

any other children their respective heirs and assigns as tenants

in common and not as joint tenants I give and bequeath unto my son

Samuel Perkins his executors administrators and assigns all my estate and

interest in the mill close of meadow called Orphans Mead

and premises at Hungerford Farleigh in the county of Somerset

I am now in the possession of for terms of years which are partly

unexpired but subject nevertheless to the payment of all rent

and other outgoings for the same from the first quarter day which

shall happen next after my death it being my will that at such

quarter day my said son Samuel shall have liberty to take

absolute possession of the said mill and premises on his own account

As to all the rest residue and remainder of my monies securities

for money stocks funds goods chattels rights credits estate

and effects whatsoever and wheresoever and of what nature or kind

soever the same may be which I shall be possessed of

interested in or entitled to at the time of my decease I give

and bequeath the same and every part thereof unto the said

William Perkins Benjamin Brown and Henry Batten Pooll

their executors administrators and assigns upon the trusts hereinafter

mentioned expressed and declared concerning the same

that is to say upon trust that the said William Perkins

Benjamin Brown and Henry Batten Pooll my said trustees

or the survivors or survivor of them his executors or administrators do

and shall with all convenient speed after my decease collect get

in and receive such part and parts of my said residuary estate and

effects as shall consist of money and make sale and dispose of

such part and parts thereof as shall not consist of money by

public auction or otherwise as to them or him shall so

????? and out of the monies thereby arising and to be received

collected and gotten in to pay and discharge in the first place all

my just debts funeral expenses and the costs and charges of

proving his my will and after satisfaction and payment thereof

in trust to pay and discharge the following legacies within

one year next after my decease namely to my son William

Perkins the sum of one hundred pounds to my daughters

Ann Perkins and Lydia Perkins and my said son Samuel Perkins

the sum of one hundred and fifty pounds each to my son Thomas

Perkins the sum of fifty pounds and to my said daughter

Elizabeth the sum of seventy pounds all which legacies I

desire may be considered vested interests respectively and after

payment and satisfaction of such legacies respectively in

trust that they my said trustees or the survivors or survivor

of them his executors or administrators do and shall lay out and invest all

all the residue of such monies to arise from my said residuary

estate and effects either on government or other good security

and pay and apply the yearly sum of sixty pounds part of the

dividends interest produce and proceeds thereof half yearly to

or ??? p????? and ??ffer my said wife and her assigns to receive

the same to be applied for and towards the maintenance of my

said wife and all such children as I may have by her at the

time of my death (or born in due time afterwards) during

the minority of such children respectively the surplus of

such dividends interest and produce to accumulate to increase

and augment my residuary personal estate hereinafter

directed to be equally divided between all my children

and when and as such children of

my said wife shall severally attain the age of twenty one

years or such of them as shall be a daughter or daughters

shall marry under that age with the consent of my said

wife and trustees or the survivors or survivor of them then

in trust that they my said trustees or the survivors or

survivor of them his executors or administrators do and shall pay unto

every such child of my said wife whether son or daughter

the legacy or sum of one hundred and fifty pounds each on

their respectively attaining such age or first marrying as

aforesaid as the case shall happen and subject to the same

last mentioned legacies and to the payment� thereof in trust

to pay the yearly sum of forty pounds part of the interest

dividends produce and proceed then arising from the residue

of the monies to arise from my said residuary estate and effects

unto my said wife Sarah Perkins and her assigns for and

during the term of her natural life the surplus of such

dividends interest and produce accumulate to increase and

augment my residuary estate hereinafter directed to be

divided from and immediately after the decease of my said wife

upon trust that they my said trustees and the survivors or survivor

of them his executors and administrators do and shall will and truly pay or

cause to be paid unto all and every my children without or

distinction including my son John Perkins all the residue

of such principal monies and all interest dividends accumulations

and savings thereof or due thereon equally between them share

and share alike the share of each to be a vested interest and

I hereby nominate constitute and appoint them the said

William Perkins Benjamin Brown and Henry Batten Pooll

joint executors in trust of this my will and I direct require

and declare that they and each of them shall be answerable

and accountable only for so much as they shall respectively and

actually receive by virtue of this my will nor shall they

any or either of them be answerable or accountable for the

???? misapplication or nonapplication of the said trust

monies the same happening without their wilful default

or neglect nor be answerable or accountable for the others

or other of them but each of them for his own acts and deeds

only and I hereby declare and direct that it shall and may be

lawful to and for my said trustees and the survivors or survivor

of them his executors and administrators to deduct and retain to them

and himself all reasonable costs charges ????? expenses and

damages whatsoever which they any or either of them

may sustain expend be at or be put unto in the execution

of the aforesaid trusts or in relation thereto in witness whereof

I the said testator have to this my will contained in three

sheets of paper to the two first sheets set my hand and to

this third and last my hand and seal this twenty seventh day of

September in the year of our Lord one thousand eight hundred

by the said testator as and for his last will and testament in the

presence of us who in his presence at his request and in the

presence of each other have subscribed our names as witnessed

The Will of John Perkins 1822

This is the last will and testament of me

John Perkins of Langham in the county of Wilts fuller First whereas

I am entitled at the death of my mother in law Sarah Perkins to a legacy

left me by my late father Thomas Perkins of Iford in the county of Wilts Also

in case my sister Elizabeth Perkins dies without lawful issue I am entitled to

a share of the three houses in Road in the county of Somerset in the occupation

of Uriah Head Henry Tanner and Henry Gaivers I give and bequeath all the

said property to my two friends William Perkins of Trowbridge in the county

of Wilts clothier and Henry Batten Poole of Road in the county of Somerset

clothier their heirs and assigns for the use following viz that they do place

out the proceeds of the said property all good security and pay the interest

arising from the same to my wife Sarah Perkins for and during the term of

her natural life and after her death equally divide the principal between

my son William Perkins and my daughter Elizabeth Perkins their heirs and

assigns and I do hereby utterly disallow revoke and disannul all and every

other former will and testament by me in any ways before named willeder

bequeathed ratifying this and no other to be my last will and testament

In witness whereof I have here unto set my hand and seal this ninth day of

July one thousand eight hundred and twenty two – The mark of X

Administration granted to Sarah Perkins widow of the deceased on 6^th

December 1831
