Conveyance of two cottages in Naish’s Barton, Road, in the County of Somerset
Dated 1st Decr 1886 (From the Trustees of the will of William Humphry, deceased, To Mr. John Moore)
This Indenture made the first day of December one thousand eight hundred and eighty-six Between James Franks of Beckington in the county of Somerset grocer and Albert Randall of Beckington aforesaid carpenter of the first part James Holland of Road in the county of Somerset labourer of the second part and John Moore of Road in the parish of North Bradley in the county of Wilts plasterer and tiler of the third part.
Whereas William Humphry late of Beckington aforesaid deceased being seized of the hereditaments hereby assured for an estate in fee simple by his will dated the eleventh day of October one thousand eight hundred and eighty-six after appointing the said James Franks and Albert Randall (therein spelt Randell) to be executors and trustees thereof devised and bequeathed all his real and personal estate whatsoever and wheresoever unto his trustees upon trust with all convenient speed after his decease to sell and convert into money the same or such part thereof as should not consist of money and to apply the proceeds thereof as therein mentioned.
And whereas the said testator died on the twenty-second day of October one thousand eight hundred and eighty-six without having revoked or altered his said will which was duly proved by the said executors and trustees James Franks and Albert Randall on the twenty fifth day of November last in the District Registry attached to the Probate Division of the High Court of Justice at Wells.
And whereas the said James Franks and Albert Randall caused the hereditaments hereby assured forming part of the real estate devised by the hereinbefore recited will to be put up for sale by public auction at Road aforesaid on the twelfth day of November last at which sale the said John Moore being the highest bidder was declared the purchaser of the same at the price of fifteen pounds.
Now this indenture witnesseth for effectuating the said sale and in consideration of the sum of fifteen pounds to the said James Franks and Albert Randall paid by John Moore (of which sum the said James Franks and Albert Randall hereby acknowledge the receipt) the said James Franks and Albert Randall as trustees hereby convey unto the said John Moore.
All that cottage or tenement lying and being in Naish’s Barton in Road in the county of Somerset formerly in the occupation of Daniel Wilcox together with a piece or parcel of ground as the same was heretofore marked out containing three perches (more or less) nearly adjoining the said cottage and also All that other cottage or tenement situate in Naish’s Barton in Road aforesaid formerly in the occupation of William Silcox together with the piece of ground as the same was heretofore marked out containing three perches more or less nearly adjoining the said last mentioned all which said premises are now in the occupation of Isaac Keevil together with the free use by the owners and occupiers for the time being of the said premises hereby assured in common with the owners and occupiers for the time being of the five cottages adjoining of the well of water pump and privy situate in or upon the piece of land adjoining the cottage formerly in the occupation of George Carter which said well pump and privy are henceforth to be cleaned and repaired with the joint expense of the owners and occupiers for the time being of the said five mentioned cottages respectively. To hold the same unto and to the use of the said John Moore in fee simple.
And the said James Holland hereby acknowledges the right of the said John Moore to the production of an indenture of conveyance dated the twenty-fifth day of March one thousand eight hundred and sixty-seven and made between Charles Happerfield of the first part Thomas Woolley of the second part and the said William Humphry of the third part and to the delivery of copies thereof and hereby undertakes for the safe custody thereof
